As North America prepares for the 2026 review of the United States–Mexico–Canada Agreement (USMCA), two issues have emerged as significant obstacles to investment certainty in the region: double taxation and Mexico’s judicial reform. While the USMCA serves as the backbone of regional trade and investment, it does not include a dedicated framework to address double taxation, instead relying on bilateral tax treaties that can create uncertainty for firms operating across borders. At the same time, Mexico’s judicial overhaul is rapidly reshaping the country’s legal landscape, raising questions about legal predictability, institutional capacity, and the handling of complex commercial and financial disputes. 

This panel will examine how these issues intersect with the USMCA review process, exploring their short- and long-term implications for investors, policymakers, and regional economic integration.
